So sitting waiting to make a left turn and this guy was speeding around a corner in the bike lane and hit the front of my car! Poor Yaris :\ The guy said he was quote 'Healthy as a horse' at the scene when the officer asked him if he was hurt or injured so the officer didn't make a report since no one was injured. Now he changed his mind and is saying he's injured what a fucking liar, probably just trying to scam me for some money, well he's not going to win this.

He wasn't hurt at all, i was just waiting and he was speeding around the turn in the bike lane and he barley clipped the front of me.

Was the dude on a bike? What was he doing coming after you in the left turn lane? Did you get your hands on a copy of the police report - you mentioned no report was made but were notes taken?

No report .....no evidence . If it comes down to it subpoena the dispatch record . They ( Police ) must give them to you under the Freedom of Information Act . Then you can subpoena the officer .
Was any damage done to the other persons mode of transportation ?
Did you file a claim with your insurance ?
Did the other person file a claim with their insurance ?
I don't see a bike lane in the pics you posted ....

the way i understand it, seems like a frontal hit then, the corner being the one the driver would have been taking had he not turn left. i had a bad experience with a bicyclist one, the car ending up being hit wasnt mine tho. But man did the bike guy fly.

Exactly right, he came around the corner WAY too fast, and was over inside the bike lane and swerved when he saw my car and kissed the front of my bumper.
Why are you guys asking if it was a bike ? I never said bike, i just said he was driving in the bike lane. he was in a was Mazda miata

This picture makes me think even more that the other dude was in a bike .... even though I now understand that he wasn't. Anyways hope all goes well!!!

Hmmm, judging from the tire marks in your first photo, he was over or beyond the white line right around you. As well, you can bring up the point that he was probably going too fast.
However, you may still lose - you were taking a left at the time, and invariably it's on you to make it safely. People making left turns in accidents usually get the fault on them.

my car was not moving, i hasn't started going yet, i looked to my right to see if it was clear and this guy just smacked my car, i was completely stopped.
Damn, sorry to hear that man, totally sucks. Same thing happened to my brother accident when a dude claimed he wasnt hurt at the time and then decided to change his mine, BS!!!
Was the bumper the only thing hurt? Suspension, frame, engine, etc ok? If its just the bumper then its only a cosmetic problem. You should get an aftermarket bumper for you sedan!! I recently messed up my bumper in an accident too and I think I'm going to get the naristo bumper.
I know that wont make everything better, just the hassle of going through all this accident/legal/money crap can take a toll on you :frown:.

Talk to a lawyer. Discuss suing him and your insurance agency. Subpoena the cop who interviewed him when he said he was healthy.

+1, esp around here, I can't remember how many times I've been cut off. I wonder if it's due to the Yaris' stubby nose.

i think a dash cam would come especially handy because our gauge cluster is in the center, a camera suctioned to the middle dome light would catch your speed for those times you need to argue a speeding ticket and for traffic accidents over "who was going too fast"
Or just go crazy and get a DVR to record multiple cameras: front, back up,
inside.

Neither do I, but unless you aren't telling the truth about what happened there is no way you should have to suffer for this because based upon your description and the photos you did nothing wrong. You don't have to lie or cheat, but don't be a doormat either.
I just gotta ask, based on the pictures and a speeding miata, were you cruising a run? :)???

The same thing just happened to me recently - biker turned into my lane without looking and smashed into the side of my car. Damage was pretty bad but my insurance was kind enough to cover it all.

The mofo can claim that id3379 was to far out into his path of traffic. I suggest gathering evidence that Mr. mofo was not in his lane.

My insurance is considering it my fault, i gave them proof of why its not, They still think he was the victim. And unless i wanna take them to court and get into expensive laywer fee's there's nothing i can really do against them.
Sucks but it could be worse. I just make sure im way farther back from now on.

1) How does an officer not write a police report at the seen of an accident...I can see if the damage was less than $500 and you have a $500 deductable. But that looks like a whole new bumper which is more than $500 for sure.
2)Did the guy get ticketed? I don't see how he didn't as he was clearly in your lane? Did the officer assign fault?
3)How the hell does an insurance company that you make payments to every month/6 months deny a claim from an accident? Is it because there was no ticket written?
4)How is the guys back hurting your problem? He ran into you...although if there wasn't any fault assigned or a ticket written I don't really think you have a leg to stand on with the insurance company:iono:

For $800 I'm pretty sure you can take them to small claims court...which the threat of will likely threaten them enoug that they'll just pay you. Although them paying you and NOT his insurance company, who should be the ones paying, will result in your rates being raised:frown:
