View Full Version : So I'm driving down the highway...

...and WHAM! This 16 year old kid in a Lexus GX460 (big) slams on his breaks and swerves infront of me. I slam on mine and swerve to the right, away from him. He loses control as do I. I hit the right guardrail while he spins backwards. We impact eachother, I try and gain control and end up hitting the left guardrail. I stop. He stopped in the middle lane on the highway, facing the wrong way.
SOMEHOW no one else was involved, even through I went sideways across two lanes of highway traffic.

He was fine. I was okay. Took an ambulance ride to the hospital. Sprained neck and back. Some vertebrae are out of whack.
But it's a great way to get rid of a car! And I was thinking that I got ripped off on it, too.
Anyways. I miss my Yaris. I'm gonna go for a 2-door LB in black with all power.
Just felt like sharing.

I'm not at fault. I'm waiting on the verdict from their insurance company as to how much % was his fault. I guess the car infront of him slammed on their brakes, so technically there's a third party involved but they never stopped.
Mine is absolutely totaled. No one was cited for anything, unfortunately. I was just reacting to what he did.

First, glad to hear everyone's ok. But the third party isn't at fault, the guy in the lexus was following too close, and from the sounds of it cut you off, pretty much leaving 100% on the lexus. I'd fight anything less

OUCH that's gotta hurt , glad your okay though ,
and best of all you get to join the hatch back club .
They are a lot nicer than the Sedan's :eek: :laugh:

Glad You're Ok! I would think the police would be looking to give someone from the incident a ticket for something, but maybe they don't share my way of thinking.
Hatchbacks > Sedans... :smile:

Here in CA, > $500 damages and the police is involved.
Man, I feel bad for that yaris, though, that had to hurt.
Glad you're OK, glad your both OK and nobody else got hurt.

Who says these "small toybox cars" are not safe? Looks like it held up rather well to me.
That car gave it's life for yours. Glad to see your doing alright over there.

hmmm, some vertebrae are "whack"? Meaning they became misaligned? That can lead to a very bad life in the future. You might have a case on hand. But glad you're alive and kicking still.

Document everything and find a good personal injury lawyer.
If you have a spinal injury you may be in for years of grief. Hopefully not but...

good luck finding a black hb. you might have to go used. i was just at the toyota site the other day and for whatever reason black wasnt an option for the build-your-own yaris thing. but you never know. :wink:

Get your self a lawer if there is any injury. He is at fault and legal counsel can prove it . I still have problems with a rotor cuff that was torn in an accident 10 years ago. I got adequate compensation for the loss of my vehicle , but I should have dragged his ass through the fire for medical expense and personal compensation. Don't let the claims adjuster bullshit you .It is their job to talk you into taking as little money as possible. Half of what he says will be lies.

I'm in the process of talking to a lawyer.
And I ended up getting a Corolla. All they had for Yaris' in the 2door was automatic; actually, all they had was automatics. So I opted for a 2010 Corolla CE 5 speed. All in all, it ended up being cheaper than the Yaris was. I will never deal with Route 44 Toyota in Raynham, MA again. They rip you off.
Anyways. It's not exactly what I wanted, but that's okay. I guess you can't order a power windows/locks package with the CE. I figure winters coming, so all I really need are power locks and that's not hard at all to do; just need 150$ and a Saturday.

Unfortunately in the North East this is why you really need to look 2 or even 3 cars ahead of you.
If weather conditions don't get you, someone pulls a stupid move like trying to stop on a dime in the center lane.
For a while they were even catching insurance scammers staging accidents along the 495 corridor through Haverhill & Lawrence. They would purposefully force a rear ender like this with some old clunker, and hopefully get the insurance settlement before the DMV figured it out. The Lexus in front of you would have been a good mark.
Who knows if this was something intentional or just someone forgetting they were still on the freeway and the vehicles behind them are moving at 70+. Tough loss for your car, but that little thing took the hit from the guardrail and the big Lexus, and held up enough for you to walk away.
Perhaps consider a much brighter color for the new one? Or at least some really bright headlamps.

Hmmm. My old Yaris was bright freakin' red, and still got T-boned by a red light runner. New one is black. If they don't see you, you might as well be fluorescent cat-puke green - they STILL won't see you.
