Well yesterday (5/5/07) while going to work on the 91 in traffic, my wife was rear ended by a Jetta and puched into a Ram. They were only traveling about 20mph but the front of her car was pretty much jacked.:cry: She was ok which is what really counts but I'm pretty sure her car is totaled. As for the other cars, their damage was only minor and they were able to drive away. Damn, I loved that little car but I don't think they're made to drive away after even a small accident. It kept her safe though. She wasn't really hurt, only a mark on her neck from the seat belt. The airbag deployed also but she wasn't burned. I think I'll get her an FJ Cruiser so she'll be able to see a little better over other cars. I love the Yaris, I just don't like it being a total loss after an accident that minor. Well it was fun while it lasted.:brokenheart: This is a great site BTW again! Keep up the good work!:respekt:

Glad she is ok!
The little car is designed to have the engine fold under the drivers compartment in frontal collisions keeping the occupants safe. When the body crumples there is less energy transfered to the occupants. In my opinion I would rather replace the vehicle then suffer serious injury from absorbing direct kinetic energy through rigid body structure.
BTW, with fuel costs out there just filling up your FJ this summer will be enough to buy another YARIS.

That is not necessarily so. We have no idea how fast the Jetta was traveling at the time. She could have been pushed a considerable distance before reacting to the collision.

Glad she's alright man, thats whats important.
For this reason alone (micro car in an SUV world) I keep my wife in the Armada. Screw the 11mpg, at least I know she's safe with the kids.
FJ's are very nice, and Im really liking the new Tundra's. Does your wife have a long commute to work? Does she need such a good MPG car (Yaris)?

Wow! That's a bummer! Sorry to hear your loss, glad your wife is okay. Man does that suck. Got a new car and then wham! So I assume insurance will give a decent check? Get a RAV4, they have decent mileage, not to say the FJ Cruiser is bad but I don't know. Its up to you! Good luck!:thumbsup:

A civil suit would be useless without personal injury. if you could prove loss of income due to injury then a settlement would most likely get you a little jingle. The only way to prosper in these situations is through permanent disability. I personally would much rather keep on trucking with a bruise vs disability.

and trust me a permanent disability takes years to settle, my cousin is still fighting 5yrs later...sure they wanted to settle for a small amount, but he has brain damage, needs 24hr care..

She wasn't following the Ram too close. It was one of those cases when traffic, typical of the 91, stopped fast and suddenly. The girl that hit my wife first said she was trying to get from the fast lane to the slow lane because her next exit was comming up. The accident was right before the exit so the Jetta was obviously looking into the next lane, not paying attention in fron of her. My wife only got close to the Ram when traffic stopped and not following close.

WORD!:thumbsup: No actually she's only 15 minuted away. I've been trying to get her to drive my Taco but she's not comfortable with how long it is.

She only rear ended the Ram because the Jetta pushed her into it. I'm sure the insurance company will take that into consideration.

The Jetta should be the one at fault for both vehicles.
And yes, the person who read-ended is usually at fault. It's nothing to do with where you live. It's simply that the person who rear-ended was following too closely or not paying attention and that's generally the cause of the accident. If they were following the minimum suggested distance, they should have ample time to slow down/stop safely without hitting the person in front of them.
I got hit in my old car. There was a cop who had someone pulled over on a limited access highway where there were stoplights every mile or two (this is in CT, not far from Hartford). Of course, the cop on the side caused everyone to watch what was happening over there and while they were, the light a few feet away turned red so there was a chain reaction of about 6 cars coming to a sudden stop. My friend was in front of me and had to swerve into the turning lane because his brakes weren't so good. I stopped fine and had plenty of time to look behind me as I got pummeled by someone going somewhere around 40mph (oddly enough in a Jetta). His car was completely ruined. My car had some scratches in the rear fender and the automatic trunk release never worked again (I didn't get anything fixed because the Escort wasn't worth the $2000 estimate to get it fixed - took the money and paid a few months rent instead). Anyway, turned out the driver was 16, only had a permit, and wasn't with an adult (his friends were in the car). Plus, you're not supposed to drive on limited access highways with only a permit. So he got 3 tickets with the following too closely one. Honestly, I don't think he was even that close to me. He just was paying fuck all attention with a cop there because he wasn't supposed to be driving the car.

Here are two things that everyone should remember if they are ever in an accident, assuming that it is the other persons fault, like someone rear ending you. Make sure and complain of lower back and neck pain, and ALWAYS get carried off in an Ambulance to the hospital, when it goes to court it is almost impossible to completely disprove lower back pain. And although this may sound ridiculous make sure that when you're still in your car to wet your pants, that will tack on another 15 to 20k for emotional and mental distress. One of my best friends is a personal injury attorney, although i hope it never happens if someone ever hits me, you can trust that they will have a huge lawsuit on their hands, and for my extra 20k i'll pee my pants all day long......
All of this is assuming that you have a very good driving record.....

this is the whole reason in the states that we have a hard time organizing events, or even having other families kids play on your trampoline. thanks to all the sue happy people here:mad:

Re. insurance fraud: I used to work for a major insurance company, and I can tell you, its costs consumers billions in increased premiums to cover the costs of paying fraudulent claims. What's really incredible is that industry studies show that up to 35% of the public believe it's "all right" to cheat this way, to make up for their premiums being so high! :iono: Ouch, the stupid...it hurts...

first and foremost im glad to hear that your wife was okay in the yaris.
mine drives one to and i sort of worry about the size vs. safety.
unrelateted, my tingly sense has to ask you if the wheels were damaged. if not, well you get the idea. well hell on that case you should ask your insurer if you could possibly by her back, at usually a drastically reduced cost, and part her out here. my older brother bought his 02 civic ex back from the insurer for 4000, after parting it out im sure he made about 3k in profit. he loves e-bay.

I understand that a lot of people claim for fraudulent damages, but the system is in place for people who are seriously injured. As of right now, I was rear-ended on the 2nd of this month, and although I didn't really exhibit any signs other than discomfort for the first 2 days, when I returned to work on the 4th, I ended up having a complete lock down in my back. Since then, I have had to see a chiropractor everyday being that my spine has been knocked out of alignment. I'm not saying that I deserve thousands upon thousands of dollars, in fact, I'm at th epoint of just worrying that I'll have all the medical bills covered by the guys insurance. But living in constant pain for the last couple weeks has been absolute misery, and with the doctor (I've seen 3 so far) have all said that it could take months at a minimum to fix and that with therapy it will get worse before it gets better really makes me frustrated. As of right now my job is being really awesome about the fact that I have a extremely limited profile, but in the future I don't know how the situation will continue. I have no other qualifications for anything other than a physically laborious job, and this accident has seriously limited my abilities, and could possibly reduce my abilities in the future. So now I'm at a point where I am trying to figure out what I'm going to be able to do.
Long story I know, but just understand that not everyone is out there for just monetary gain and looking to make a dollar, but that some people are seriously in need of compensation for lawyer fees and medical bills. Trust me, its seriously not worth having to deal with this much pain and discomfort to make a buck, I'd rather go build a house with bricks for a year than have to live through this for another week.

DO NOT sign any waiver offered by the defendants insurance company! If you have conferred with your own legal council do so immediately.

All I can say is that with the amount of pain killers I've been on since the accident, I don't think I'm legally allowed to defend myself! :) Anyways, I've got my attorney taking care of everything while I try and get my spine re-alligned.
