Sorry, but you'd actually lose. Unless you can prove that you absolutely had to hit the brakes at that exact point on a highway, any competent judge would realize you were just being an asshole.

I've brake checked plenty of people, including motorcycles, which is always awesome, but don't delude yourself into thinking you'd get away with it if you cause an accident.

animal darted out in front of me...

either way the rear-ender would STILL get a "following too closely" ticket regardless.
