Well I got robbed...!

Title says it easily enough.


Orlando, FL
June 10th, 9:45pm EST.

I was enjoying my lunch at a local Subway shop, with my girlfriend, already ordered and was about to finish up and leave, when 2 men entered the store, they were wearing all black, covered faces with (dew rags) and hoodies up. They demanded that all 4 of us (guests if you will eating there) remain quiet and dont say a word. Mind you that the 2 men were armed, one with what looked like a 9mm, the other with an automatic handgun. Neither of them removed the guns from their pants...they had them showing.

Note the whole time we were sitting down at the tables, not moving or trying to make a scene...

Now, one man stayed to watch us in the dining area, while the other went back to find the poor girl who was working there, yes she was working alone that night, he dragged her to the front and demanded she open the register. She did so, then they came around and told us to give us what we had on us, at this time I noticed that I stupidly left my $400 ($190 with contract) Phone on the table cause I was playing with it only minutes before...well that was now gone, wherever that guy put it. I handed him what money I had in my pocket ($8 tops) and then proceeded to watch him go to the other couple and take the guys phone (turned out to be his work phone) and his cash ($5-10).

The one guy decided to not pay attention that the other guy took my shit already, so he decided to ask us for what we had...we promptly told him that the other guy already took all our stuff, and they were about to leave. When the guy decided to pat me down while sitting, noticed my wallet, which had nothing in it, other than my ID and Insurance cards, and a badly destroyed ATM card. Needless to say he wanted my wallet, I tried to tell him to back off that that there was nothing in the wallet, as soon as I took it out to show him, he took it and both of them hauled ass out the door.

After all this went down, we found out the girl working saw the men enter the store then pressed the silent panic alarm, which was to send a signal to the police to send help, that didnt work. So after a 911 call, the cops showed up, did their whole small investigation, then decided that they wouldnt be able to figure it out that night.

They tried to track the guys with a dog, but only followed them for a short time before the dog lost the scent (they got into a car).

The two men were best described as 21-29, African American in race, and seemed experienced in doing this kind of thing...they werent too jumpy about anything, very planned. Whole ordeal took only 6 minutes tops.

Police took statements then let us go after 2.5 hours of sitting around watching them work.

Needless to say I am out a good chunk of cash due to having to replace my phone.

My question is...
Should I contact a lawyer for the 5 of us, to try and see if the Franchise company or even the alarm company should be held liable for a faulty alarm system that could have further put us into a dangerous situation, if the men decided they didnt just want our money...

Do I need to contact the Franchise company to try and see if they have insurance to cover the replacement of my phone, seeing they must have insurance to cover their loss, I dont see why the insurance wouldnt cover the victom's damages as well. We were there during the robbery, hence what we lost is technically part of the whole ordeal.

Overally it was a shitty situation.

I already went to the DMV and got a new ID, contacted my insurance companies and got my banking situation solved with closing of all my old accounts and opening new ones.

Just sucks ass...
Any suggestions on my questions?

can you really sue the subway or the alarm company for a faulty alarm cus you get robbed in their store?

edit: sending to a friend of mine in law school (but its canadian law school)

i would call a lawyer that has a free assesment thing.. and pitch the idea to them.

subway didn't have anything that worked in place to keep you safe. who knows if they ever test the alarm to see if it works.. I would think they would be able to replace the phone.. $400 is a drop in the bucket for subway

arghhhhh if you had turned on Latitude on your G1 we could have been tracking your phone right now and helping the police catch those scumbags

Glad you are okay!

I imagine that was not a good time and eating in a fast food place is no good for you anymore.

I agree (but I am no lawyer) that subway should replace your missing items.

yeah, i've been told at my job NOT to hit the silent alarm until after the suspects leave. we're told to cooperate with them and get them out quickly. i guess they don't want an opportunity for things to possibly get worse if police cars pull up? glad everyone is ok!

Sucks this happened to you. Have you got a copy of a police report stating that you've had your wallet stolen? If not get one, If you have one keep it in a safe place as these low life scumbags more than likely will try and get credit cards and maybe even loans in your name and give you a bad credit rating.

Also for everyone else here on the forum I recommend you take every card out of your wallet/purse and place them on a photocopier. Photocopy both the front and back of all your cards, that way not only do you know the numbers on the cards, but you also know the phone numbers to ring to get these cards cancelled when they are no longer with you (e.g. stolen or lost).

I'm just glad no one got hurt. As for you trying to get Subway to pay for the phone, it's worth a shot, but I doubt you'll get anywhere with it. It's up to you to look after your own property, not Subway (yes I am aware you were robbed and that it sucks).

I'm sorry this happened to you, but in all honesty...get a damn handgun, even if you resent it. If it happened there once your neighborhood must be shitty like mine. I am not saying to be the hero, but if they did have a gun and they pulled it out, you would all be dead right now. I know you don't want to think of the what ifs, but it is a possible scenario

Did you get insurance on the phone? even they should be able to replace it with a police report etc...but I am glad to see that you and everyone else is ok... assholes like that suck

Well I do have an insurance plan or my phone...

I am not really in the mood to sue, but that was something that someone I know told me to look into...

I think that I will be contacting Dipasqua (the Subway franchise) to have they reimburse me for the cost of my deductable on the insurance. Which is $130.
