Thanks for the support, I'm going to let State Farm handle it. They laughed and said they should have my money within the month from Geigo then I can get her fixed. Driveable now so I can wait with Xmas and all coming.

I got rear ended by some dumb teenager (my car was 6 months old at the time) on her cell phone while I was at a dead stop on the freeway, and she dodged the insurance company for almost 2 full weeks - in MN, the 'guilty' party has to admit guilt (no fault state) before their insurance would cover it. I finally got pissed and called my insurance company and they laughed, said 'that's cute she thinks she isn't going to have to pay .... if you want, we will file the claim then sue her and her insurance company'

...I called her insurance company back and told them that my insurance company will file the claim then they can deal with them in court and all of a sudden I got a call from a claims adjuster saying that her parents admitted it was their daughters fault and I could bring my car to the shop at anytime :)

Sometimes, insurance companies can be lame.

To the original poster, I hope that your situation comes out however you would like it to - and try to get the claim settled with open medical! I got rear ended when I was 16 and we never thought to file for medical becuase at the time I felt fine. 8 months later I developed serious back problems that went unnoticed and caused from the accident. You never know how long down the line it will start messing with you! So I hope your wife is OK, and make sure she's covered!

I guess earlier I missed a call from the body shop and the estimated damage is $8,396, and I'm sure that # is going to go up. If they total it I'm probably going to get a base model Civic or a regular cab Tacoma.
