rear right toe is out of spec? What to do?

Considering a 07 Yais sedan with no modifications, If the rear right toe is out of spec (and can't be adjusted) and if there is no problem with the beam can you say that the car was sent to the dealership out of alignment. Also, would this be considered a manufacturers defect. If it cant be adjusted how can you get the rear right toe to be within spec for a 4 wheel alignment.

you could say that it is manufacturer defect if all the following is met:
-your the 1st and only owner of the car
-tire wear was abnormal before the first 15,000 miles,

then toyota will do an inspection under warranty and fix the issue or they will buy back your yaris.

BUT being an 07 I doubt any dealership will accept any fault and say its been in an accident or jumped a curb at some point in time.
