He said that's how fast he was driving, but it looks like he was going a bit slower to me.

Poor Yaris indeed.
Best wishes for prompt recovery to your wife. Glad she walked out of the car mostly OK. |

Good to know, I just got mine yesterday Are they damaged at all from the impact? Any dents in the rims?

I just got back from the body shop and the guy was telling me that they'll (Farmers) total out my car if the damage is more than 75% of the market value of my vehicle. Edmunds values my car at
trade in: $8,964 private party: $9,871 retail: $10,659 Edmunds seems like a more realistic price than what KBB says my car is worth ($12,235) so hopefully they total it. If they don't total it, I'm going to be stuck with a car that isn't worth shit if I ever trade it in or sell it. Will my insurance fight for me since my car depreciated A LOT because of their (Allstate's) client??? Do you guys think I might get compensated for that???? Plus I don't want my wife to drive a car that will never be the same, and might be structurally compromised. Here's a pic of the inside of the car where the dipshit hit (the hatch won"t budge):

That's the kind of stuff that really increases the repair quote. It starts with the superficial bumper damage, and then snowballs from there with all of the structural and sheetmetal damage.
My money is still on total. |

I would say he was going a lot slower than 55. I got hit in my sedan in the rear at about 20mph last tuesday and the damage estamate is around 1600 bucks. The other guys insurance company, Geigo, is saying it was my fault and wont pay. I was sitting and waiting for a stop light and the 17 yr. rear ended me. Death to the lizard. Hope the wife is ok and no long term affects.

dunno, my Yaris looked like this and they didn't total it... something like $8000 worth of damage (I think, it's been a few months...)

Totaled or not. I don't think anyone comes out ahead either way in car accidents.

I don't see how you can be hit in the rear and it be your fault.

It appears that the 17 old told his Claim rep that I cut him off, which I didn't as I was sitting waiting for a light to change. Only property damage done and under 2000, no damage to his car, the police didn't even do a report. It also appears that the 17 year old had had another accident 10 days prior and trying to save his parents insurance butt by saying I cut him off, but didn't. Will let State Farm, my insurance company, handle it. Geigo says its his word against mine and wont pay.

It sucks when the cops don't do a report. Were there any witnesses? With the punk just having another accident though, eep, good luck with the fight.

You can't be 100% at fault, but could be 50% at fault. At least that's how it is here. Too many rules.
