Problems?

sounds like you are accidentally placing the car in 3 instead of D when you come out of the neutral you should make sure the selector moves over to the right.

It will solve his "not shifting after 40 mph" problem. As far as the brakes go be sure the check the fluid level. I would also go back to the dealer and ask them to bleed the brakes for me.

It is because you did not let it warm up upon starting it. The "cool temp light" on the dash must go off before driving. It will not shift properly and stays in 3rd gear. I think it is a MAJOR safety issue and am probably going to get rid of my yaris for this issue.

Another STUPID idea from toyota...

This "stupid" idea lowers your maintenance costs long term. I fail to see how in anyway this could be construed to be a safety issue of any kind. A major safety issue in my opinion is something like the fuel tank in the Ford Pinto. Not an feature which forces the engine to be warm before shifting like it would under optimal temperatures.

It's also better to drive the car slowly as soon as you start it versus idling. Better for fuel efficiency and better for the maintenance of your car.

Seems like you hate a lot of things about your Yaris. I suggest you research and test something better before you buy it next time. Sure, the Yaris is far from perfect and some things about it annoy me (The warm up feature which prevents proper shifting until a proper engine temp is reach, included), but the Yaris is a great car for what it was intended to do.

Ok lets see...Car cool temp light is still on after warming a few minutes or you drove off slowly to let it warm...OH CRAP there's a car that I must avoid hitting me in the rear because I driving slow on the highway. I mash the gas pedal and nothing but over tached motor and no shifting...going 40 mph tops...SMASH!!!you just died because your car was in cool temp mode...DO YOU SEE NOW? or should I elaborate more? I think it's a stupid idea and have never had another vehicle of any kind do that. And I have had quite a few cars, trucks, and suv's. I have been driving for 26 years and that is longer than most of you have even been alive. Unlike a lot of members here, the yaris is NOT my first car.
I have my opinion and you have yours. I don't like that you and others flame me because I don't live in your "Toyota is God world". I like my yaris very much BUT it is NOT the best thing since sliced bread. It does what I bought it to do...save gas and be reasonably dependable and low cost of ownership, PERIOD...So stop your flaming and whining and understand that not everything is perfect with this car...

SHWING!!! Mine has a 5-speed...and so did my Escort GT...and my Contour SVT...oh dang it!!!! Guess what? STILL got rear-ended in both of those cars while minding my own business. Was hurt pretty seriously in the Escort and did $8K damage to the rear...estimates are that the guy was going about 90mph. Wouldn't have mattered if it was winter or summer, stick or auto, there are some accidents that just can't be avoided when the other guy is driving wreckless and about twice as fast..

My dealership took care of that "safety issue" for me; they sold me a 5-speed.

ALL cars have this same "issue" as you call it. All cars(AT) must warm up properly before they will shift correctly. Toyota has given you a light to know when the warm up period is over and you can drive it normally. Stupid idea? So it's stupid for them to let the driver know when its "safe" to drive normally as oppose to other cars that you have to "guess" when the car is warmed up. Also, my dealer told me that it was better for the life of the car to drive it carefully during the warm up period instead of letting it idle to warm up.

No i make sure its in "D" on the dashboard, and i check and look to see its to the right side.
