Oh man, that sucks, I hate it when people try to pull of this kind of shit and get away with it. It's one of my biggest pet peeves. That and hit-and-run. Be a man, take responsibility for your actions, wuss... In situations like these I wish there was a way to humiliate this punk, if there was a video recording or something, to show everyone what a lying bastard he is...

Sorry if I got carried away ... it's just such a shame...

I don't see how you could be 1% at fault here... He was waiting at a traffic light!!! What was he supposed to do? Predict the future and drive away to avoid being hit in the rear?

Thanks for the support, I'm going to let State Farm handle it. They laughed and said they should have my money within the month from Geigo then I can get her fixed. Driveable now so I can wait with Xmas and all coming.

I got rear ended by some dumb teenager (my car was 6 months old at the time) on her cell phone while I was at a dead stop on the freeway, and she dodged the insurance company for almost 2 full weeks - in MN, the 'guilty' party has to admit guilt (no fault state) before their insurance would cover it. I finally got pissed and called my insurance company and they laughed, said 'that's cute she thinks she isn't going to have to pay .... if you want, we will file the claim then sue her and her insurance company'

...I called her insurance company back and told them that my insurance company will file the claim then they can deal with them in court and all of a sudden I got a call from a claims adjuster saying that her parents admitted it was their daughters fault and I could bring my car to the shop at anytime :)

Sometimes, insurance companies can be lame.

To the original poster, I hope that your situation comes out however you would like it to - and try to get the claim settled with open medical! I got rear ended when I was 16 and we never thought to file for medical becuase at the time I felt fine. 8 months later I developed serious back problems that went unnoticed and caused from the accident. You never know how long down the line it will start messing with you! So I hope your wife is OK, and make sure she's covered!

Good luck to you guys ... and your Yaris

The guy said he hit her at 50 or so, but it does look worse in person

I guess earlier I missed a call from the body shop and the estimated damage is $8,396, and I'm sure that # is going to go up. If they total it I'm probably going to get a base model Civic or a regular cab Tacoma.

No, if you are stopped you are 100% NOT at fault. But, here if you are moving a bit, you can be 50% at fault if the police say you slammed your brakes on or something. It is pretty stupid.

I was rear ended a few weeks ago, the guy was going about 50km/h and it did little to no damage, I was surprised how tough this car is.

No police report done as there was only property damage. Basicly it comes to his word against mine because of the lack of a police report.

Anybody who hits someone else in the rear is at fault. You shouldn't be following closely enough that you'd hit them if they slammed on the brakes unexpectedly.

Farmers totalled it WHOO HOOO!!!!!! Tomorrow I have to meet with the adjuster and go over how much her car is worth. All I have on the car are the Konig wheels and a drop in AFE dry filter. They should cover my wheels since I pay to have $1000 of aftermarket stuff covered.

I gave up on getting a regular cab Tacoma because owning 2 regular cab trucks is pretty retarded. We checked out Mazda 3's the other day, I was actually surprised at how nice they are compared to Corolla's and Civics that are the same price. They look way better too. We are deciding between a Civic coupe or a Mazda3, leaning towards the 3.

I'm wondering how much they'll want for the salvaged Yaris???

Crashy v2.0 lol

Farmers valued my car at 12,800 LOL, my payoff is $6,000. I'm thinking about putting $5,000 down on our next car and maybe buying a older Toyota pickup with the leftover money.

My wife is pretty dead set on getting a 4 door Mazda3i Sport, I wish I could afford a MazdaSpeed3 haha. Here's pretty much exactly what she wants but a 4 door.
