Mostly true, but the police/DA will not charge you for talking and driving, but if they find you have altered your ride in an unsafe way, they would/could throw the book at you.
When I race motorcycles I know I can/will go down at some point. I wear proper PPE as to minimise my injuries, and so does the guy next to me.
On the street if one acts unsafe, others may suffer. Thats my point.
